Chapter 7 and Chapter 11 of the bankruptcy code allow creditors the option of filing for relief against the debtor, also known as involuntary bankruptcy. The purpose of this publication is to consider many of the issues that creditors face in commencing an involuntary bankruptcy petition. Consideration is given to the benefits and risks of commencing an involuntary petition; to pre-filing issues, such as qualifications of creditors and the standard that must be established to obtain an order for relief; and, to post-filing issues, such as litigating an involuntary petition, joinder of creditors and dismissal of an involuntary petition.
