A significant aspect of complying with rules of conduct and avoiding penalties is tied to the client-practitioner relationship. Meeting ethical obligations in this area requires compliance with the high-level standards of honesty, integrity and objectivity. More specifically, this translates into rules governing communications, conflicts of interest, confidentiality, privilege, privacy, and terminations. A checklist approach will be covered that can help practitioners meet their ethical obligations. Relevant tax penalties, Circular 230 and professional rules of conduct pertinent to client relationships will be addressed.

ANNETTE NELLEN, CPA, ESQ., is a professor in and director of San José State University's graduate tax program (MST), teaching courses in tax research, accounting methods, property transactions, state income tax, ethics, tax policy, and high technology tax issues. Ms. Nellen is the chair of the AICPA Individual Taxation Technical Resource Panel and is a member of the Executive Committee of the Tax Section of the California Bar. She maintains the 21st Century Taxation website and blog (www.21stcenturytaxation.com). Prior to joining SJSU, she was with Ernst & Young and the IRS. |
