Circuit’s decision largely striking down the FCC’s Net Neutrality rules but upholding its authority to regulate broadband services under section 706 of the Telecommunications Act, has reached a new fever pitch with Chairman Tom Wheeler’s late April circulation of a new NPRM and a proposed substitute standard—“commercially reasonable.” The FCC is slated to issue the new proposals on May 15. This timely CLE will dive into the key issues, starting with an analysis of the D.C.
