It’s BAAAACK: Federal Register Publication of the “Preserving the Open Internet” Report and Order – What It Means for the Broadband Industry and Those that Follow It


The FCBA Broadband Committee will hold a CLE on Monday, October 17, 2011 from 6:00 – 8:15 p.m. entitled It’s BAAAACK: Federal Register Publication of the “Preserving the Open Internet” Report and Order – What It Means for the Broadband Industry and Those that Follow It.  This CLE will provide a review of three key legal aspects of the Open Internet Order: (1) its current status and expected legal challenges; (2) new rules of the road and possible compliance; and (3) the Order’s unique complaint/enforcement process.  It will be held at Arnold & Porter LLP, 555 12th Street, NW, Washington, DC.

6:05 – 6:35 p.m.         The Current Status of the Open Internet Report and Order

An update on the legal state of play of the Report and Order, both at the FCC and before the courts.  Panelists also will discuss some of the key legal issues that will be argued by likely proponents and opponents of the FCC decision.

6:35 – 7:15 p.m.         The New Rules of the Road and Enforcement Procedures (Part I)

Speakers will discuss the scope of the Open Internet Report and Order rules and the four core principles of the item: transparency, no blocking, no unreasonable discrimination, and reasonable network management.  Speakers will review the scope of the rules (what services are covered and for what technologies); how companies are approaching the “guidance” of the Order and the Public Notice issued this summer in developing compliance efforts; and what the complaint process might mean for enforcement of the rules.

 

Part I will focus on the scope of the Open Internet rules and the transparency rule.
