Department of Health & Human Services’ Office for Civil Rights (OCR) can issue fines to HIPAA covered entities and business associates that fail to implement necessary safeguards to secure protected health information (PHI).  There are two areas of vulnerabilities with Health Insurance Portability & Accountability Act (HIPAA) for most home health & hospice agencies that will be addressed in this webinar series.  The first vulnerability is the annual education- agencies need to educate different levels of staff not just nursing.  In 2016, there were 43 instances where employee error caused breach of information resulting in more than 1.2 million records at risk.  Also, many contracts are beginning to ask for validation of your HIPAA training program.  Having solid education will support an organization during an audit or breach. 

The second area covered in this webinar series is conducting a HIPAA Risk Assessment. Penalties from OCR are not just for major breaches (over 500) but also for smaller breaches (example: Hospice of North Idaho was fined $50,000 for not protecting 441 records).  In March 2016, North Memorial Health Care of Minnesota paid $1.5 million to OCR after a HIPAA audit revealed that the organization did not conduct a proper risk assessment.  Don’t delay, conduct a risk assessment to determine areas that create the greatest risk for your agency and begin to mitigate those risks before disaster strikes and the agency is faced with loss of information, penalties and a damaged reputation.

Conducting a HIPAA Risk Assessment, October 12, 2017 12:00-1:00 pm

Description: Every HIPAA entity is required at a minimum to annually conduct a HIPAA Risk Analysis.  The requirement was first introduced in 2003 and subsequently extended to cover the administrative, physical and technical safeguards of the HIPAA Security Rule.  Fines to covered entities are levied frequently in this one area.  Learn how to properly conduct this assessment.

       Objectives:

  • Review HIPAA’s Current Climate of Audits

  • Discuss the components of a HIPAA Risk Assessment

  • Learn to identify likelihood of a threat

  • Learn how to properly conduct this assessment (who, when, how)

Presenter:  Joan Usher, BS, RHIA, ACE, President, JLU Health Record Systems is a nationally recognized AHIMA Approved ICD-10-CM trainer.   Joan has a degree in Health Information Management and has been a home health consultant for over 28 years. She has educated more than 15,000 people in nationwide on coding. Joan is past president of the Massachusetts Health Information Management Association (MaHIMA) and has served three years as a delegate for American Health Information Management Assn (AHIMA).  Usher is a Board of Director of Hospice & Palliative Care Federation of MA.  Joan's webinars consistently earn outstanding reviews from participants.
