Tax: The Role Municipal Government Plays in Economically Rooted Discrimination

Municipal governments can stop the perpetuation of economically rooted discrimination by paying attention to disparate treatment such as over-charging and over-taxing of women’s feminine products and by prohibiting employers from requiring salary history from prospective employees. Philadelphia attorneys will discuss the national evolution of unequal consumer pricing on feminine products such as the “Pink Tax” in addition to salary history protection in Philadelphia to prevent perpetuation of the gender and racial salary gap.

Speakers: Jane Istvan,  Kaitlin McKenzie, and Mary-Kate Martin  

Jane Istvan oversees the Appeals Unit for the City of Philadelphia Law Department.  During her 25 years with the Law Department, Jane has briefed and argued many complex litigation matters, and advised City agencies on many First Amendment speech and religious liberty claims. One of the most difficult cases Jane ever briefed was the City’s successful defense of its salary history ordinance, Greater Philadelphia Chamber of Commerce v. City of Philadelphia, 949 F.3d 116 (Cir. 2020). Jane received her J.D. from Yale Law School, and she is a Phi Beta Kappa graduate of the University of Virginia.  She clerked for the Hon. Robert S. Gawthrop III of the United States District Court for the Eastern District of Pennsylvania.  

 

Kaitlin McKenzie, a Partner at Faegre Drinker in Philadelphia, helps rein in concerns arising from business tax and escheat/unclaimed property issues. She provides clarifying counsel on sales and use taxes, income and franchises taxes, withholding tax and unclaimed property services. Kait also represents clients in audits, appeals, return positions and litigation. She collaborates with clients across industries and state jurisdictions, including Pennsylvania, New Jersey, Delaware and Philadelphia. Kait’s astute approach to tax matters led to her 2015 appointment to Philadelphia’s Tax Review Board (TRB). She was tapped by former Mayor Michael A. Nutter to help resolve nonjudicial disputes regarding city taxes, charges, fees and fines. Kait earned her J.D. and LL.M. from Villanova University School of Law, and her M.B.A. from Temple University Fox School of Business. 

 

Mary-Kate Martin is a Deputy City Solicitor in the Tax Revenue Unit of the Philadelphia Law Department. For the past ten years, her focus has been litigating market value appeals, real estate tax, use & occupancy tax, and realty transfer tax. In addition, she manages the City’s PILOT agreements, and mentors law school interns. Mary-Kate is a 2011 graduate of the Drexel University Earle Mack School of Law, and a former judicial law clerk in the Philadelphia Court of Common Pleas. For seven years she contributed to the Philadelphia Bar Reporter monthly newspaper, most of which was spent serving as Editor-in-Chief or Associate Editor
