From the perspective of the U.S. Department of Labor (DOL), the top six Wage and Hour mistakes employers make are:

  1. Not counting all hours worked, including incorrectly calculating wait time and on-call time
  2. Allowing compensatory or flex time
  3. Misapplying exempt status to non-exempt, salaried employees
  4. Not calculating appropriate overtime and subsequent payment
  5. Improperly calculating meals and break time
  6. Limiting the number of hours employees are allowed to record
