The Taxation of "Exotic" Investment Products
Investing has gone beyond stocks, bonds, and mutual funds. Today, high-net-worth individuals are being offered an array of alternative asset classes and investments. From commodities, exchange-traded notes, to foreign sovereign and emerging-market debt, these investments often utilize complex financial instruments and derivatives, catch the taxpayer and tax professionals unaware. This presentation will discuss the taxation of these “exotic” investments pointing out traps, where the tax code is unclear, and where tax advisors are likely to see change in the future.

John C. Akard served as a United States Bankruptcy Judge for the Northern District of Texas, 1986 – 2000. He also has served as a recalled judge in the District of Delaware, the District of Maryland and the Western and Southern Districts of Texas. For close to 25 years, John was the Trustee under Chapter 13 of the Bankruptcy Code in the El Paso Division of the United States Bankruptcy Court for the Western District of Texas and in the Midland-Odessa Division of that court. He was an Assistant Professor at the University of Texas at El Paso where he taught Business Law, Real Estate, Corporation Finance and related subjects and a former member of the El Paso law firm of Akard & Kirk, which concentrated its practice in the area of real estate and bankruptcy law.
Sherri K. Anderson, Esq., CPA, is an
Attorney and CPA with over 30 years of accounting, tax and business experience and
7 years of legal experience, and holds dual licenses to practice law and public
accounting in Oklahoma. Sherri’s current
practice includes tax law and some tax accounting, estate planning, probate
actions. Sherri also handles various family
law matters, has utilized her dual licenses as either an Attorney or CPA in
several Collaborative Divorce cases, and has served as the Treasurer for the
Oklahoma Academy of Collaborative Professionals since 2008. She earned her BBA
in Accounting from UCT Tulsa (Langston), her JD from the University of Tulsa’s
College of Law, and also holds a Masters in Tax from TU’s Business
College. Prior to law school, Sherri worked
primarily in industry as a controller or in other accounting and management
positions, and has operated her solo law practice under the name of Anderson
Law Firm, PLLC in Tulsa, Oklahoma since 2007.

William Hornberger, Esq., LL.M., CPA, tax practice emphasizes transactional and international tax matters and tax controversy issues. Willie served as the Chair of the Dallas CPA Society, the Chair of the Section of Taxation of the Dallas Bar Association and the Chair of the Section of Taxation of the State Bar of Texas and the Executive Committee of The Real Estate Council. He currently serves as a member of the Executive Board and the board of directors of the Texas Society of CPAs. He has served as an Adjunct Professor in Taxation at the SMU Law School. Willie is a speaker and author on both domestic and international tax topics and he has been listed in “Best Lawyers in America” under Tax Law since 2003.
David Klasing, Esq. M.S.-Tax, CPA is a dedicated tax professional with over 18 years of experience.
He is licensed to practice both as an Attorney and a Certified Public
Accountant. As a former auditor, Mr. Klasing uses his past experience in accounting
to help clients avoid tax problems before they arise and where necessary
provides zealous representation during audits, criminal investigations or tax
related litigation. Mr. Klasing has a proven and sustained record of achieving
favorable outcomes for his clients in Taxation, Estate Planning, and Business
Law.
David holds a Master’s Degree in Taxation with an
emphasis in estate & gift tax from Golden Gate University and a Juris
Doctor from Western State University College of Law. He is admitted to practice
before all California State Courts, the United States District Court for the
Central District of California and the United States Tax Court.
David's professional involvement includes serving as
the current chair of the California State Bar Association, Tax Procedure and
Litigation Committee and the Orange County Bar Association Taxation Section.
Steven
Moore, Esq., is a state tax lawyer
whose practice includes planning and controversy work emphasizing sales tax,
Texas franchise (aka "margin") tax, and insurance premium tax. He is dedicated, from a value driven perspective, to helping his clients fully
comply with and control their tax exposure. Steven has extensive experience in state tax
planning for multi-state business models, and regularly provides tax strategy
advice relating to business acquisitions and divestitures. An effective
negotiator, Steven works to reach successful and economically viable
resolutions to Texas sales, franchise, and insurance premium tax audits. To
this end, Steven handles administrative hearings before the Texas
Comptroller of Public Accounts and works with the firm's litigation group to
prosecute judicial resolution of Texas tax cases. Recognized for his depth of
expertise in state tax matters, Steven is one of the state's leading
attorneys for guidance on the new Texas margin tax and he frequently speaks on
this topic, with ongoing commitments for presentations to Texas State Bar and University
of Texas CLE programs.
John W. Pramberg, Esq. is
a practicing attorney in Newburyport, Massachusetts specializing in tax advice
and planning, estate planning and administration, administration of trusts,
representation of professional trustees, advising and representing charitable
trusts and foundations in Essex County Massachusetts. He has also acted as
co-counsel with other criminal defense counsel where fraud and substance abuse
issues are involved. John received his B.S. from Babson College in
organizational behavior, while taking sufficient courses to qualify to sit for
the C.P.A. exam. He served his apprenticeship with Tofias, Fleischman &
Shapiro in Boston and received his masters degree in tax law from Bentley
College. John received his law degree from Suffolk University. For over 25
years John served in various appointed and elected positions in state and local
government in Massachusetts, retiring in 2004 to devote full time to his
growing family and developing his law practice. He has been an instructor in
the paralegal studies program at Northern Essex Community College in Haverhill,
Mass and a member of the American Bar Association Committee on State and Local
Taxation. Besides his law practice, John spends a great deal of time as an active
trustee of private family trusts and several large charitable trusts and
foundations in northeast Massachusetts and southeastern New Hampshire. John has
been a life member of the Association since 1984 and is the National Secretary.
Brian Yacker, Esq., CPA, has over 20 years of tax, legal, and accounting experience in
the exempt organizations area. Brian focuses exclusively in working with exempt
organizations. In this regard, Brian possesses a vast amount of experience and
expertise in preparing and reviewing Forms 990, 990-T, 990-PF and state
tax-exempt forms. Brian also has extensive experience in the preparation and
filing of both federal and state tax exemption applications for public
charities, private foundations, and other exempt organizations. Areas of exempt organization consultation
which Brian possesses expertise include public support test calculations and
planning, preparation of reasonable compensation rebuttable presumption binders
and Reasonable Compensation Studies, governance best practices consultation, recommendations
regarding effective Bylaws, conducting of EO Governance Check-Ups, compliance
with the §501(h) lobbying safe harbor, proper functional expense allocations, maximizing
charity watchdog ratings, and the proper internal and external reporting of
special event fundraisers.
Representative clients include hospitals and other healthcare
organizations, universities and colleges, private foundations (family foundations/private
operating foundations/corporate foundations), trade organizations, social

co-leader of the OC-LB EO Interest Group and the soon to be formed San Diego EO
Interest Group.
