Ethics and Legal Liability in Tax Practice

Presented by: Jim Rigos, JD, LLM, CPA

Program Description

AICPA and IRS Publication 230 controlling rules.  We cover all three roles; planning, tax form preparation and representation under audit.   While much of this is applicable to state, local, and other taxing jurisdiction the emphasis here is on the federal return issues.

 

Learning Objectives

Sensitize Attorney - CPAs to applicable professional tax standards and IRS rules and procedures.  Emphasis is not on the tax law as such but rather the three roles of transaction planner, preparer, and controversy advocacy in and after a revenue agent's n audit.   We cover not only legal liability for damages but also ethical responsibilities.   Emphasis is on avoiding situations that involve a heightened risk of a legal malpractice claim.   The course includes a proposed client engagement letter with protective positions that will be discussed which will allow the practitioner to custom make their own "liability environment" contract.

Education

The course should qualify for 2 hours of CPA CPE (100 minute) and/or Bar CLE tax ethics (120 minute).   Note this course is not approved by any State Board of Accountancy for their state-specific ethics credit but should qualify for the general 40 hour annual requirement as the AAA-CPA courses are NASBA approved.

About the Presenter

James J. Rigos, JD, LLM, CPA

Jim Rigos is an award winning presenter and attorney-CPA who has written and lectured widely in accounting, ethics, and legal topics.  He graduated from Boston University Law School and has served on the AICPA's Accountants Liability committee.  He is presently a National Director of the American Academy of Attorney-CPAs and chairs their national ethics and dual practice committee.
