Speaker Information

Peter Middleton
Peter represents a diverse range of clients ranging from international Fortune 500 companies to small mom-and-pop businesses. In the recreational and hospitality law setting, he has defended hundreds of clients ranging from rafting outfitters, zip-line course designers, equipment manufacturers, hotels, restaurants, and retailers. Whether the liability exposure is big or small, Peter prides himself in providing personalized, passionate, and cost-effective services for his clients.
 

In 2013 Peter obtained summary judgment in a wrongful death action on behalf of a rafting outfitter alleged to have committed negligence and willful and wanton conduct. The trial court in that case held that the release signed was valid and enforceable, and that there was no willful and wanton conduct as a matter of law by the guide involved or by the outfitter.  In 2014, the Colorado Court of Appeals upheld the trial court’s decision on all counts and Peter recovered costs of the lawsuit on behalf of his client.
 

In 2015, Peter obtained dismissal of a lawsuit on behalf of the host of an iconic Colorado festival in a premises liability action. He then recovered $75,000 in legal fees and costs for his client. The injured person had alleged that the festival host was liable for catastrophic injuries sustained in a motorcycle accident and sought over $1M in in damages. The Court was convinced that the case lacked factual and legal merit and sanctioned the plaintiff’s counsel for overly aggressive litigation. Also in 2015, Peter won a summary judgment motion on behalf of a concert venue in a case where it was alleged that there was a dangerous condition causing a head injury at a rock concert. In 2016, he obtained a defense verdict on behalf of a tavern and its manager who were sued for assault, battery, and false imprisonment.
 

Peter speaks regularly at events and seminars geared toward the outdoors and rafting outfitter industries. He has investigated numerous fatalities and other serious incidents in their aftermath to ensure thorough, proper and effective investigations and preservation of evidence. In his spare time, he spends time with his family and enjoys mountain biking, hiking, camping, and the occasional craft beer.
 

Ryan Winter
Ryan L. Winter is a Member with Hall & Evans, LLC. Ryan has successfully defended hundreds of tort cases in state and federal court, and a significant part of his practice involves the defense of clients in the sports and recreation industry. He has served as the contact partner and supervising attorney on numerous high exposure, high profile lawsuits. Ryan has achieved defense verdicts in state and federal court, prevailed on appeals, and obtained summary judgment for his clients. He is Martindale-Hubbell® AV Preeminent Peer Review Rated.
 

Ryan is a graduate of the University of Colorado School of Law, and clerked for the Supreme Court of Colorado. He is published and has lectured on a host of litigation related topics, including in sports and recreation law. Ryan was lead counsel in an important 2016 case involving a rafting fatality in which the U.S. Tenth Circuit Court of Appeals upheld the enforceability of a release. Since that time, he has continued to provide counsel for outfitters and guides, including authoring releases, representing them before the IBLA, as well as defending them in state and federal court. In his free-time, Ryan is avid snowboarder, mountain biker, diver, and outdoor enthusiast, and he takes pride in representing the industry that helps him enjoy these pursuits.
