Construction:  Back to Basics:  Guide to Avoiding & Mitigating Construction Claims

Description: The construction industry has faced many unique challenges since the start of 2020. As the industry adjusts to the new “normal” way of working, it is important for construction project participants to maintain focus on the basic techniques that are effective in managing construction risks that are inherent to every construction project. This session will bring participants “back to basics” and provide simple techniques that can be applied every day for the avoidance and mitigation of common issues that often manifest into complex construction claims. Our “back to basics” fall 2021 session will focus on dispute resolution.

 

Bryan Payne, Esq., PE, CCP, CFCC, brings 27 years of experience in the transportation, higher education, and healthcare construction sectors in construction management, claims avoidance and mitigation, mediation, and contract administration. His strength is in solving construction problems and resolving disputes before litigation and getting broken programs back on track. Bryan has proven expertise in working on programs with shared governance, multiple funding sources, and complex grant requirements. He is used to working closely with governing board members and is an experienced public speaker. Bryan is a Registered Civil Engineer and a licensee attorney of the State Bar of California. He has served as mediator for over 50 litigated cases for the Superior Court of Los Angeles County and is admitted to practice before the U.S. District Court for the Central District of California.

 

Brian Goodreau, PSP, ENV-SP, is a senior leader responsible for managing the Arcadis Contract Solutions team of experts in dispute resolution, project controls, and risk management located in New York City. He is an experienced team leader with a proven record of accomplishment helping clients solve their most complex problems by implementing techniques such as CPM scheduling and total cost management. Brian has also effectively resolved numerous disputes on behalf of his clients, providing expert analysis and litigation support. Brian has been involved numerous alternative dispute resolutions including negotiations, mediations and claims review boards.

Throughout his career, Brian established himself as a thought-leader in the construction industry. His hands-on experience coupled with his knowledge of industry best-practice and interpersonal skills provides him with the tools required to be an effective team leader.

Prior to Arcadis, Brian worked as a project manager for a masonry subcontracting firm for nearly a decade. Throughout his career, Brian has held positions as project manager, scheduler, project controls manager, and claims analyst. His experience in the field coupled with his skills of the latest technology provides him with the tools required to be an effective analyst on complex claims.

Brian is a graduate of Central Connecticut State University with a Bachelor’s Degree in Construction Management and is a certified Planning and Scheduling Professional (PSP) with the Association for the Advancement of Cost Engineering International (AACEI). Brian is an accomplished public speaker and AICET Certified training instructor. He is often invited to speak at seminars on construction claims and managing projects more effectively.

 

Antoine Bechaalani, PSP, is a Project Scheduler and Claims Analyst for the Arcadis Contract Solutions team of experts in construction disputes and project controls in New York City. He has more than nine years of experience in the engineering and construction industry. His experience ranges from industrial, federal, educational, and healthcare projects in the U.S. to commercial and residential projects in Lebanon and the United Arab Emirates. In support of claims and litigation situations, he has been the leading analyst on numerous projects providing schedule delay and change order analyses, damages quantifications, and standard of care assessments. He excels at providing strategic solutions to clients to effectively avoid, mitigate, and resolve construction claims and disputes.
