RECOMMENDED PRACTICES FOR DESIGN PROFESSIONALS ENGAGED AS EXPERTS IN THE RESOLUTION OF CONSTRUCTION INDUSTRY DISPUTES (Download)
Forty-two prominent organizations have unanimously endorsed 13 recommendations developed to enhance ethical performance by design professionals on the witness stand, at depositions, and in their forensic activities. Some of the recommendations are made specifically to counter widespread abuses of "hired guns," experts who see their roles as advocates of their clients' positions rather than reporters of facts and honest opinions. Issues covered include conflicts of interest, reliance on assumptions, limiting research to an artificially small number of cases, methods to identify standards of care by which design professionals' acts are evaluated, qualifications for accepting an engagement, integrity of tests, illustrative devices, custody and control of materials, confidentiality, demeanor, and fees, among others.
