This presentation will focus on the Departments of Health and Human Services disqualification process for employees providing direct care in certain health care, social services personal care assistance professions.  This will include the process from the agencies’ background study through disqualification and the administrative hearing. The presentation will be of interest to attorneys in the public and private sector who may represent clients at DHS fair hearing appeals.

The presentation will cover and answer these questions:
-What is Minnesota Department of Health’s role in disqualifying health care professionals from employment at MDH-licensed facilities?
-What is DHS-OIG’s role in disqualifying health care professionals from employment at DHS-licensed facilities?
-What are some of the disqualifying events?

-What is the administrative process to challenge an MDH or DHS disqualification?
-What is the role of the DHS Appeals Office?

-How does the hearing process work?
