THE FINANCIAL RISKS ARE SUBSTANTIAL

The Hospice of North Idaho was fined $50,000 for not protecting 441 records. Excel Plus Home Health Inc. in TX reported theft of a desktop with 524 patient’s information. In March 2016, North Memorial Health Care of Minnesota paid $1.5 million to OCR after a HIPAA audit revealed that the organization did not conduct a proper risk assessment. Fines like this could cripple a home care or hospice agency.

The Office of Civil Rights (OCR) issues fines to HIPAA- covered entities that fail to implement the necessary safeguards to secure protected health information. HIPAA compliance is more than just annual training. This webinar will cover three areas where agencies should focus attention now!

ASSESSMENT - Don’t delay, conduct a risk assessment to determine areas that create the greatest risk for your agency and begin to mitigate those risks before disaster strikes and the agency is faced with loss of information, penalties and a damaged reputation. The first area covered in this webinar is conducting a HIPAA Risk Assessment.

BREACH - In 2017 alone, there have been 4,482,025 breaches reported. In 2016, there were 43 instances where employee error put more than 1.2 million patient records at risk. Even small breaches must be self-reported to the OCR by the March 1 deadline.

CONDITIONS OF PARTICIPATION Implementation of the new emergency preparedness rules involves developing a method for sharing of information with other healthcare providers in an emergency as part of your communication plan. Do you know what is permissible under HIPAA?

Objectives:

Understand the necessary components for a solid HIPAA Risk Assessment:

  • Who should be involved?

  • When & often do we need to perform the assessment?

  • What are best practices for performing the assessment?

    Learn the steps for breach mitigation and reporting

  • What is considered a breach?

  • What state & federals agencies need to be alerted of the breach?

  • How do we need to alert our patients affected?

Discuss the proper way to share information with other healthcare providers during an emergency.

  • Making sure that health information is available before, during and after an emergency is a critical.

  • Understand how the HIPAA regulations during an emergency.

Presenter:  Joan Usher, BS, RHIA, ACE, President, JLU Health Record Systems is a nationally recognized expert in health information. She has a degree in Health Information Management and has been a home health consultant for over 33 years. Joan is past president of the Massachusetts Health Information Management Association (MaHIMA) and has served three years as a delegate for American Health Information Management Assn (AHIMA). She received the Distinguished Member award from MaHIMA in 2017 and the Professional Achievement Award in 2008.  Usher is a Board of Director of the Home Care Alliance of MA and the Hospice & Palliative Care Federation of MA.
