Construction: Alternative Project Delivery: What Went Wrong
Construction owners are seeking to find better methods of procuring construction projects than the traditional Design-Bid-Build method. Do you know what the advantages and disadvantages are of alternative project delivery methods such as Design-Build and CM At Risk? This presentation will explain the differences between these alternatives, and share best practices for how to make each method successful. Additionally, how disputes are handled will be discussed.
After attending this presentation, participants should be able to: (1) Describe reasons, expectations and results of increased use of Alternative Project Delivery; (2) Compare the Design-Build and CM@Risk methods based on the following: Advantages and disadvantages, Best Practices, How the Spearin Doctrine applies, and Potential areas of dispute; and (3) Explain unique dispute resolution aspects of Alternative Project Delivery.
Speakers: Bryan Payne and Lisa Jones
Bryan Payne, Esq., PE, CCP, CFCC brings 27 years of experience in the transportation, higher education, and healthcare construction sectors in construction management, claims avoidance and mitigation, mediation, and contract administration. His strength is in solving construction problems and resolving disputes before litigation and getting broken programs back on track. Bryan has proven expertise in working on programs with shared governance, multiple funding sources, and complex grant requirements. He is used to working closely with governing board members and is an experienced public speaker. Bryan is a Registered Civil Engineer and a licensee attorney of the State Bar of California. He has served as mediator for over 50 litigated cases for the Superior Court of Los Angeles County and is admitted to practice before the U.S. District Court for the Central District of California. Lisa Jones has over 20 years of experience in construction specializing in contracts management, she has a strong background in construction contracting, legal research and writing, and claims analysis. Adding to the diversity, she has worked on behalf of the contractor, represented the owner as an owner’s representative, negotiated contracts on behalf of the developer, and as a consultant. She has experience observing civil and criminal cases and engaged in case discussion with bench officers in the Los Angeles Superior Court. She has served the Court as a Mediator. She has also trained under the court clerk to calendar case files, case management, and enter judgments and conducted legal research as needed Lisa also has experience performing document review and prelitigation preparation including propounding and responding to discovery, preparation for and conducting depositions, preparation of deposition summaries, preparation of trial binders and witness preparation on behalf of law firms.
