DESCRIPTION
There are some provisions impacting hospices in the CY 2024 Home Health Prospective Payment System Rate Update proposed rule that was released on June 30, 2023 which could significantly impact hospice. The rule includes the awaited hospice special focus program and an informal dispute resolution process as well as changes in the provider enrollment process including:
- moving some hospices into the “high risk” enrollment category
- implementing a 36-month rule under which the provider agreement and Medicare billing privileges do not convey when a hospice is undergoing a change in majority ownership (CIMO) by sale within 36 months after the effective date of the hospice’s initial enrollment or within 36 months after the hospice’s most recent CIMO
- de-activation for 6 months of non-billing
- changes surrounding managing employees and ordering, referring, certifying or prescribing suppliers or providers
