To be eligible for Medicaid, an individual must meet eligibility requirements which are based on federal and state law. Of the general qualifications, financial eligibility is the most confounding.  The program will focus on income and asset issues (including divestment of resources) in seeking to qualify for long-term care.

“Decanting” a Trust – Why, When and How

Unlike fine wine, a trust will not necessarily get better with age.  Decanting a trust – pouring assets into a second trust with more desirable terms – is like getting a “do over.”  More than half of the states now permit decanting under appropriate circumstances.  The program will review how decanting works and when it may be appropriate.

How to Report Illegal Source Income on a Tax Return

Whether you are engaged as a preparer or tax consultant, you will encounter clients who have illegal source income from drugs, prostitution or even theft.  What must be disclosed on a tax return in order to avoid a further crime?  This session will answer questions related to proper verbiage and accounting where illegal source income is involved.

In 2018, IRS began utilizing a new weapon against “seriously delinquent tax debt”, denying passport applications and revoking outstanding passports under legal authority granted two years earlier.  While the law may apply to anyone owing $52,000 or more in back taxes, many exceptions apply.  The program will look at exceptions and advise you as to how to handle a proposed denial or revocation.

Tax Issues in LLC Formation

The limited liability company has become the entity of choice in part due to its flexibility.  For a multi-owner LLC to avail itself of many favorable opportunities such as avoiding income on disproportionate contributions, the Operating Agreement requires proper wording.  The session will cover the tax issues in setting up an LLC and the needed provisions to minimize taxes.

Just as significant issues abound in the formation of an LLC, they also exist in dissolution.  Objectives may be the avoidance of any gain recognition or, if unachievable, the minimization of ordinary income.  The program looks at the tax issues in putting an LLC to rest.

Celebrities are not immune to being defendants against criminal tax charges or being plaintiffs in civil actions.  Among the celebrities who have been convicted or pled guilty to tax charges are Martha Stewart, Leona Helmsley, Wesley Snipes and Pete Rose.  Those who have fought the IRS in Tax Court have included former Treasury Secretary Andrew Mellon, Conway Twitty, Jack Benny and Groucho Marx.  Can we learn from their run-ins with the Service?  You bet your life!
