2020 was a very turbulent year! Sheriffs’ offices around the state have been involved in litigation regarding mortgage foreclosure, redemption, and overage issues.
State and federal moratoriums on mortgage foreclosure sales and evictions have also created troublesome issues for Sheriffs. Certain foreclosures may proceed while others cannot. For example, the state moratorium on evictions allows some cases to move forward while others not meeting certain criteria may not proceed.
Sheriffs throughout Minnesota have dealt with complicated redemption and overages following a mortgage foreclosure sale. Who is entitled to redeem following a foreclosure sale? Who is entitled to the overage after a mortgage foreclosures sale? A group of experts have been working on drafting legislative proposals to change current statutes that would give clear guidance to Sheriffs’ staff on dealing with these redemption and overage issues. In 2020, Sheriffs’ personnel have also been confronted with individuals who are committing fraud during the foreclosure and redemption process.
